RESOLUCI\u00d3N DE DISPUTAS<\/h2><\/div><div class=\"MsoNormal\" style=\"line-height: 1.5; text-align: left;\"> <\/div><div class=\"MsoNormal\" style=\"line-height: 1.5; text-align: left;\"> <\/div><div class=\"MsoNormal\" style=\"line-height: 1.5; text-align: left;\" data-custom-class=\"heading_2\"><h3>Negociaciones informales<\/h3><\/div><div class=\"MsoNormal\" style=\"line-height: 1.5; text-align: left;\" data-custom-class=\"body_text\"><span style=\"font-size: 15px;\">Para acelerar la resoluci\u00f3n y controlar el coste de cualquier disputa, controversia o reclamaci\u00f3n relacionada con estos T\u00e9rminos Legales (cada una de ellas una &#8220;Disputa&#8221; y, colectivamente, las &#8220;Disputas&#8221;) presentada por usted o por nosotros (individualmente, una &#8220;Parte&#8221; y, colectivamente, las &#8220;Partes&#8221;), las Partes acuerdan intentar primero negociar cualquier Disputa (excepto aquellas Disputas expresamente previstas a continuaci\u00f3n) de manera informal durante al menos treinta (30) d\u00edas antes de iniciar el arbitraje. Dichas negociaciones informales comenzar\u00e1n mediante notificaci\u00f3n escrita de una Parte a la otra Parte. <\/span><\/div><div class=\"MsoNormal\" style=\"line-height: 1.5; text-align: left;\"> <\/div><div class=\"MsoNormal\" style=\"line-height: 1.5; text-align: left;\" data-custom-class=\"heading_2\"><h3>Arbitraje vinculante<\/h3><\/div><div class=\"MsoNormal\" style=\"line-height: 1.5; text-align: left;\" data-custom-class=\"body_text\"><span style=\"font-size: 15px;\">Si las Partes no pueden resolver una Disputa a trav\u00e9s de negociaciones informales, la Disputa (excepto aquellas Disputas expresamente excluidas a continuaci\u00f3n) se resolver\u00e1 de forma definitiva y exclusiva mediante arbitraje vinculante. USTED ENTIENDE QUE, SIN ESTA DISPOSICI\u00d3N, TENDR\u00cdA DERECHO A DEMANDAR EN LOS TRIBUNALES Y A UN JUICIO CON JURADO. Sus honorarios de arbitraje y su parte de la compensaci\u00f3n del \u00e1rbitro se regir\u00e1n por las Reglas del Consumidor de la AAA y, cuando proceda, estar\u00e1n limitados por las Reglas del Consumidor de la AAA. El arbitraje podr\u00e1 llevarse a cabo en persona, mediante la presentaci\u00f3n de documentos, por tel\u00e9fono o en l\u00ednea. El \u00e1rbitro tomar\u00e1 una decisi\u00f3n por escrito, pero no tendr\u00e1 que proporcionar una declaraci\u00f3n de motivos a menos que lo solicite alguna de las Partes. Si se determina que esta disposici\u00f3n es ilegal o inaplicable, ninguna de las Partes elegir\u00e1 arbitrar ninguna Disputa que entre dentro de esa parte de esta disposici\u00f3n que se considere ilegal o inaplicable y dicha Disputa ser\u00e1 decidida por un tribunal de jurisdicci\u00f3n competente dentro de los tribunales enumerados para la jurisdicci\u00f3n anterior, y las Partes acuerdan someterse a la jurisdicci\u00f3n personal de ese tribunal. <\/span><\/div><div class=\"MsoNormal\" style=\"line-height: 1.5; text-align: left;\" data-custom-class=\"heading_2\"><h3>Restricciones<\/h3><\/div><div class=\"MsoNormal\" style=\"line-height: 1.5; text-align: left;\" data-custom-class=\"body_text\">Las Partes acuerdan que cualquier arbitraje se limitar\u00e1 a la Disputa entre las Partes individualmente. EN LA MEDIDA EN QUE LO PERMITA LA LEY, RENUNCIAMOS A TODAS LAS GARANT\u00cdAS, EXPRESAS O IMPL\u00cdCITAS, EN RELACI\u00d3N CON LOS SERVICIOS Y SU USO DE LOS MISMOS, INCLUYENDO, SIN LIMITACI\u00d3N, LAS GARANT\u00cdAS IMPL\u00cdCITAS DE COMERCIABILIDAD, IDONEIDAD PARA UN PROP\u00d3SITO PARTICULAR Y NO INFRACCI\u00d3N. NO OFRECEMOS NINGUNA GARANT\u00cdA NI DECLARACI\u00d3N SOBRE LA EXACTITUD O INTEGRIDAD DEL CONTENIDO DE LOS SERVICIOS O DEL CONTENIDO DE CUALQUIER SITIO WEB O APLICACI\u00d3N M\u00d3VIL VINCULADO A LOS SERVICIOS Y NO ASUMIREMOS NINGUNA RESPONSABILIDAD POR (1) ERRORES, EQUIVOCACIONES O INEXACTITUDES DEL CONTENIDO Y LOS MATERIALES, (2) LESIONES PERSONALES O DA\u00d1OS A LA PROPIEDAD, DE CUALQUIER NATURALEZA, QUE RESULTEN DE SU ACCESO Y USO DE LOS SERVICIOS, (3) CUALQUIER ACCESO NO AUTORIZADO O USO DE NUESTROS SERVIDORES SEGUROS Y\/O CUALQUIER INFORMACI\u00d3N PERSONAL Y\/O INFORMACI\u00d3N FINANCIERA ALMACENADA EN LOS MISMOS, (4) CUALQUIER INTERRUPCI\u00d3N O CESE DE LA TRANSMISI\u00d3N HACIA O DESDE LOS SERVICIOS, (5) CUALQUIER ERROR, VIRUS, TROYANO O SIMILAR QUE PUEDA SER TRANSMITIDO A O A TRAV\u00c9S DE LOS SERVICIOS POR CUALQUIER TERCERO, Y\/O (6) CUALQUIER ERROR U OMISI\u00d3N EN CUALQUIER CONTENIDO Y MATERIAL O POR CUALQUIER P\u00c9RDIDA O DA\u00d1O DE CUALQUIER TIPO INCURRIDO COMO RESULTADO DEL USO DE CUALQUIER CONTENIDO PUBLICADO, TRANSMITIDO O PUESTO A DISPOSICI\u00d3N A TRAV\u00c9S DE LOS SERVICIOS. NO GARANTIZAMOS, AVALAMOS NI ASUMIMOS LA RESPONSABILIDAD DE NING\u00daN PRODUCTO O SERVICIO ANUNCIADO U OFRECIDO POR UN TERCERO A TRAV\u00c9S DE LOS SERVICIOS, NING\u00daN SITIO WEB CON HIPERV\u00cdNCULOS O NING\u00daN SITIO WEB O APLICACI\u00d3N M\u00d3VIL QUE APAZCA EN CUALQUIER BANNER U OTRA PUBLICIDAD, Y NO SEREMOS PARTE NI SEREMOS RESPONSABLES DE NINGUNA MANERA DE LA SUPERVISI\u00d3N DE NINGUNA TRANSACCI\u00d3N ENTRE USTED Y CUALQUIER PROVEEDOR TERCERO DE PRODUCTOS O SERVICIOS.
